Terms and Conditions of Service - Carbon Copy Association (CC)

1. Introduction and Acceptance

 

These Terms of Use ("Terms") govern your access to and use of the internet platforms, mobile applications, and related services (collectively, the “Services”) operated by Carbon Copy Association ("CC", "we", "us"). By accessing or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications. If you do not agree to these Terms, you must not use the Services.

 

CC reserves the right to amend, update, or change these Terms at any time. We will post a notice on our website for at least 7 days after changes are made, indicating the date of the last revision. Any changes will become effective after the 7-day period or your first use of the Services after such changes, whichever is earlier.

 

 

2. Registration and Account Security

 

When registering for an account, you agree to:

- Provide accurate, current, and complete information.

- Maintain the confidentiality of your password and account security.

3.1 Property of CC

 

The content provided on CC's Services, including videos, texts, images, and interactive applications, is protected by copyright. You may not modify, transmit, disseminate, store, copy, recompile, or republish the content without prior written consent from CC. Use of this material is allowed solely for private, non-commercial purposes. Embedding any CC content in contexts violating legal provisions or morality is prohibited.

 

3.2 Rights of Use to CC Content

 

CC grants you a limited, non-exclusive, non-transferable license to download and store software, directories, data, and content expressly made available for downloading on the Services. All other rights remain with CC, and commercial use or sale of this content is strictly prohibited.

4. User-Generated Content

 

4.1 Upload of Data

 

By uploading content (videos, audios, texts, images) to the Services, you grant CC a worldwide, perpetual, non-exclusive, royalty-free license to use, display, distribute, and create derivative works from your content. This includes embedding and playing the content as a link on third-party sites or making it available through uploads on third-party sites, including social media.

 

You warrant that you have all necessary rights to upload the content and indemnify CC against any claims from third parties related to the publication of your content.

 

4.2 Indemnification

 

You agree to defend, indemnify, and hold harmless CC from all claims arising out of your use of user-generated content, including all costs and damages from valid claims by third parties.

5. Acceptable Use of the Services

 

You are responsible for your use of the Services and for any use of the Services made using your account. Our goal is to create a positive, useful, and safe user experience. To promote this goal, we prohibit certain conduct that may be harmful to other users or us. When using the Services, you must comply with our Community Guidelines.

6. Indemnification

 

You agree to defend, indemnify, and hold harmless CC and its affiliates, directors, officers, employees, contractors, agents, suppliers, licensors, successors, and assigns from any and all claims, liabilities, damages, losses, and expenses, including attorney's fees, arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

7. Liability

 

To the extent permitted by law, CC is not liable for any data and information disseminated on its Services or for any damages arising therefrom, including errors, delays, interruptions, infrastructure faults, incorrect content, data loss, viruses, or any other issues. Accessing third-party links via the Services is at your own risk, and CC assumes no responsibility for the content, accuracy, legality, or functionality of these sites.

 

CC does not guarantee uninterrupted access to its Services or the quality of such access. We reserve the right to determine when and for how long our Services are unavailable for technical reasons or service improvements. CC does not guarantee that the Services will function without interruption or error, nor that any errors will be corrected.

8. No Representations or Warranties

 

The Services, including all content, are provided on an "as is" basis without any representations or warranties of any kind, express or implied. CC disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

 

To the maximum extent permitted by applicable law, CC is not liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or relating to the use or inability to use the Services. CC's total liability for any claim related to the Services is limited to the amount paid, if any, by you to CC for the Services in the 12 months prior to the initial claim.

10. Governing Law and Dispute Resolution

 

These Terms are governed by Swiss law. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Switzerland.

11. Termination

 

CC may terminate your access to the Services at any time, for any reason, without notice. You may terminate your account at any time by following the instructions provided through the Services.

12. Miscellaneous

 

These Terms constitute the entire agreement between you and CC regarding the use of the Services. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. CC's failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
